Welcome to Fifth Element Somatics. Please read this document carefully. By booking a session, workshop, or using any service provided by Fifth Element Somatics, you are agreeing to these Terms and Conditions.

1. Nature of Services and Scope of Practice

• Somatic Healing: Fifth Element Somatics provides complementary and holistic somatic-based services, which may include Somatic Experiencing, body-awareness practices, movement, and nervous system regulation techniques.

• Non-Medical Advice: The services provided are not a substitute for medical, psychiatric, psychological, or clinical care. The Practitioner is not a licensed physician, psychiatrist, or clinical mental health therapist.

• Client Responsibility: You understand that you are the expert on your own body and life. You are solely responsible for your physical, mental, and emotional well-being before, during, and after sessions. You agree to work within your own capacity and limits, and to inform the Practitioner if you experience any pain, discomfort, or distress.

• Disclosure: You agree to disclose all relevant medical history, existing physical, emotional, and psychological conditions, and any changes in your health status to the Practitioner prior to or at the start of each session.

2. Session Protocol and Client Conduct

• Informed Consent: The Practitioner will discuss the nature of the somatic techniques to be used. You have the right to ask questions, decline any technique, or stop a session at any time without penalty or judgment.

• Physical Contact (if applicable): Somatic work may involve light, respectful touch or guidance. Any physical contact will be fully discussed and agreed upon with your explicit verbal consent before it occurs. You may withdraw this consent at any time.

• Professional Conduct: The therapeutic environment is professional and respectful. Fifth Element Somatics reserves the right to terminate a session or the entire therapeutic relationship immediately, without refund, if the client engages in any form of inappropriate, abusive, threatening, or sexualized conduct towards the Practitioner or the environment.

3. Fees, Payments, and Cancellation Policy

• Fees: All session, package, or workshop fees are as listed on the Fifth Element Somatics website or as communicated to you at the time of booking. Fees are due [e.g., at the time of booking, 24 hours before the session, etc.].

• Cancellation/Rescheduling: A minimum of [Specify Number, e.g., 24 or 48] hours' notice is required to cancel or reschedule a session.

  • Cancellations made with less than the required notice will be charged the full session fee.

• Late Arrival: If you arrive late, the session will still end at the scheduled time, and the full fee will be charged.

4. Confidentiality and Record Keeping

• Confidentiality: All disclosures made by you to the Practitioner, and all records pertaining to your sessions, are confidential, subject to the exceptions below.

• Exceptions to Confidentiality: The Practitioner is legally required to break confidentiality if there is:

  • A serious and imminent threat of harm to yourself or a reasonably identifiable third party.

  • Suspicion or disclosure of child, elder, or dependent adult abuse or neglect.

  • A court order or legal process requiring the disclosure of records.

• Record Keeping: The Practitioner will maintain clinical records (notes) as required by professional and legal standards. These records are the property of Fifth Element Somatics. Requests for copies of records must be made in writing.

5. Website and Digital Services

• Intellectual Property: All content provided by Fifth Element Somatics (website text, exercises, guides, logos, etc.) is the intellectual property of Fifth Element Somatics and may not be reproduced without written permission.

• Third-Party Links: Our website may contain links to third-party sites. Fifth Element Somatics is not responsible for the content or privacy practices of these external sites.
